An uncontested divorce is a way to dissolve a marriage out of court. Griffin, Georgia Attorney Debra Dutton helps clients obtain uncontested divorces to minimize the stress and animosity often present when a couple decides to dissolve their marriage.
Is an Uncontested Divorce Right for Me?
If you and your spouse have no disputes regarding marital property, alimony, child support, or property division and agree to the terms of your divorce, an uncontested divorce could be the answer for you. Considering the stress that can accompany even the most amicable divorce, having an attorney on your side will likely save you time, money, and anxiety. Attorney Debra Dutton will guide you through the entire uncontested divorce process and help you create a settlement agreement addressing all the issues that commonly arise in every divorce, now and in the future.
To obtain an uncontested divorce in Georgia, you must meet the following conditions:
Residency
Either you or your spouse must have lived in the state for six months before filing for divorce.
Grounds
You must have grounds, or legal reasons, to obtain a divorce. Georgia allows both no-fault and fault grounds for divorce. No-fault grounds allege that the marriage is irretrievably broken, meaning that the marriage cannot be saved.
Settlement Agreement
Once you and your spouse have resolved all potential issues, you will need to incorporate the terms of your divorce into a Settlement Agreement, a written contract between you and your spouse that is binding upon both. Each Georgia county Superior Court has agreement forms that will need to be completed and filed to complete the process.
